Possession notice period for rent arrears cases reduced from 01 August 2021

As from 01 August 2021, the notice period for Section 8 possession notices served on Grounds 8, 10 and/or 11 (rent arrears) reduced from 4 to 2 months, where the arrears owed amount to less than 4 months’ rent. Where the arrears owed equate to at least 4 months’ rent or more, the notice period remains unchanged at the existing 4 weeks’ notice.

Incidentally, a new Form 3 Section 8 notice has been released to correct a typographical error in the earlier form released to take account of the 01 June 2021 changes. The gov.uk website expressly says that this does not affect the validity of the form published on 01 June 2021.

You can find more information here about the current notice periods for Section 8 notices and Section 21 notices following the various changes as a result of the COVID-19 pandemic, which remain in effect until 30 September 2021. Whether the pre-pandemic notice periods will return after 30 September 2021 remains to be seen, but given the relative return to normality after Boris 19 July 2021 ‘freedom day’ and the return of evictions which have been taking place over the last 2 months, there seems little reason to continue with the extended possession notices.
